NSW Land and Environment Court approves retirement living units on Sydney’s Northern Beaches
Three sets of amendments were made and Michael Chilcott, NSW Land and Environment Commissioner determined that the development application, with the amendments submitted, was in the public interest and has upheld the appeal

Prospective retirement living operators Vicki Koolloos and Matthew Hazlett have taken Sydney’s Northern Beaches Council and Northern Beaches Local Planning Panel to court and won. They wanted to demolish two existing dwellings and construct five three-bedroom retirement living apartments over two semi-connected two-storey pavilions, with a driveway, parking and landscaping in Loquat Valley Road, Bayview, 31km north of Sydney’s CBD. The pair took on clause 4.6 of the Pittwater Local Environmental Plan 2014 to vary the height of buildings development standards under the State Environmental Planning Policy (Housing for Seniors and People with Disability) 2004. Vicki and Matthew had lodged the development application in October 2021 and it was refused by Northern Beaches Council and their appeal to Northern Beaches Local Planning Panel also failed.
